1. Acceptance of Terms

These Terms of Service ("Terms") govern your access to and use of Shrivo, a service for URL shortening and temporary file sharing. Shrivo is operated by a sole proprietor under the kervin.tech brand. By using the Service you agree to these Terms. If you do not agree, you may not use the Service.

2. Description of Service

Shrivo provides URL shortening and temporary file upload links. Features may include:

• URL Shortening: Create shortened, resolvable links with basic analytics
• Temporary File Upload: Upload files and share a short download link
• Usage Controls: Optional passwords, access limits, and expirations
• Analytics: High level usage statistics and download counts

The Service is provided for lawful use. Availability, features, and limits may change at any time.

3. Acceptable Use Policy

Do not misuse the Service. Prohibited activities include:

• Unlawful activity or solicitation of unlawful activity
• Violations of international, federal, state, or local laws
• Infringement of intellectual property rights
• Harassment, hate speech, or targeted abuse
• Distribution of malware or harmful code
• Phishing, fraud, spam, or scraping
• Violent, graphic, or adult content
• Promotion of illegal goods or terrorist activity
• Attempts to bypass security, size limits, or access controls
• Resource abuse including excessive automated uploads or requests

4. Prohibited Content

The following is not allowed on the Service:

• Content that violates any law or regulation
• Copyright or trademark infringement
• Viruses, trojans, or other malicious executables
• Fraudulent or deceptive content
• Hate speech or discriminatory content
• Threats or targeted harassment
• Illegal imagery including child exploitation material
• Files that reveal confidential or personal data without consent
• Tools meant to circumvent security or DRM

5. File Upload and Storage

5.1 Responsibilities

When you upload files you represent and warrant that:

• You own or have the rights to upload and share the files
• The files do not violate third party rights or the law
• The files are free of malware and harmful code
• You have consent to share any personal data contained in the files

5.2 Storage and Retention

• Fixed Expiration: All uploaded files expire and are deleted after 7 days by default.
• Backups and Caches: Deleted files may remain in backups or CDN caches for up to 30 days.
• No Backup Guarantee: You are responsible for your own backups.
• Early Removal: We may remove files sooner for policy or security reasons.

5.3 Scanning and Monitoring

The Service uses automated scanning to detect malware, phishing, and known illegal content including hash matching. Scanning is a risk mitigation measure and not a guarantee that content is safe. Apparent child sexual abuse material is reported to NCMEC. We cooperate with lawful requests.

6. User Content and License

You retain ownership of links, files, and content you submit ("User Content"). You grant Shrivo a worldwide, non-exclusive, royalty-free license to host, store, cache, transmit, display, and process User Content as needed to operate, secure, and improve the Service. The license ends when your User Content is deleted from our systems subject to reasonable backup and cache intervals.

7. Service Availability

We aim for reliable service but do not guarantee uninterrupted access. The Service may be suspended, modified, or discontinued at any time without notice.

8. Link Monitoring and Removal

We may monitor, disable, or remove links and files that violate these Terms or pose security risks. We do not review everything and are not responsible for content we do not review. Report abuse to abuse@shrivo.com.

9. Privacy and Data Collection

Your use of the Service is also subject to our Privacy Policy. We collect limited data to operate and secure the Service, including IP address, user agent, timestamps, link targets, file metadata such as name and size, hash values, and basic analytics. Access logs may be retained up to 90 days for security, debugging, and abuse investigation. See the Privacy Policy for details on purposes, retention, and user choices.

10. Age Restrictions

The Service is not intended for individuals under 13 years of age, or a higher age where local law requires. We will close accounts that appear to be under the applicable age.

11. Law Enforcement and Compliance

We may preserve and disclose information to comply with law, legal process, or government requests. We will report child exploitation content to NCMEC and competent authorities.

12. Intellectual Property

The Service, including its features, software, and content, is the property of Shrivo and its licensors and is protected by intellectual property laws. These Terms do not grant you any rights to use our trademarks or logos.

13. Copyright Policy

Shrivo respects intellectual property rights and responds to copyright complaints. If you believe that content available through the Service infringes your copyright, email copyright@shrivo.com with:

• A description of the copyrighted work
• The URL of the material you believe is infringing
• Your contact information
• A statement that you have a good faith belief the use is not authorized
• A statement under penalty of perjury that your notice is accurate and you are authorized
• Your physical or electronic signature

If your content was removed and you believe the removal was in error, you may send a counter notice with similar identifying details and a statement under penalty of perjury that the removal was a mistake. We may restore content unless we receive notice of legal action. We may disable accounts of repeat infringers where appropriate.

14. API and Rate Limits

If you access any API, you must use a valid key, follow posted limits, and avoid bulk operations that degrade service. We may revoke keys for abuse or security risk.

15. Disclaimer of Warranties

The Service is provided "as is" and "as available." We make no warranties of any kind, express or implied, including any warranties of merchantability, fitness for a particular purpose, or noninfringement.

16. Limitation of Liability

To the maximum extent permitted by law, Shrivo shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, or for loss of profits, data, use, goodwill, or other intangible losses arising from or related to your use of the Service, regardless of the theory of liability.

Shrivo’s total liability for all claims arising from or related to the Service shall not exceed the total amounts, if any, that you paid to Shrivo for the Service in the twelve (12) months preceding the event giving rise to liability. If you use the Service without charge, our liability to you is zero.

You are solely responsible for the content and legality of files you upload and any harm resulting from your files or links.

17. Indemnification

You agree to defend, indemnify, and hold harmless Shrivo and its operators from claims, damages, liabilities, and costs including reasonable attorneys' fees arising from your use of the Service, your content, or your violation of these Terms or the law.

18. Termination

We may suspend or terminate access immediately for any reason, including violations of these Terms. On termination your right to use the Service ends and files or links may be removed.

19. Governing Law and Dispute Resolution

These Terms are governed by the laws of the State of California without regard to conflict of laws rules. Before a claim is filed, the parties will try to resolve it informally for 30 days after written notice to support@shrivo.com.

If not resolved, disputes will be settled by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules in San Francisco County, California. Either party may bring an individual claim in small claims court. Class actions and representative proceedings are not allowed. You may opt out of arbitration within 30 days of first accepting these Terms by emailing support@shrivo.com with your name and the email tied to your account and a statement that you opt out of arbitration.

20. Export Controls and Sanctions

You may not use the Service if you are located in an embargoed jurisdiction or are otherwise prohibited under applicable export control or sanctions laws. You agree to comply with all such laws.

21. General Terms

• Severability: If any part of these Terms is unenforceable, the rest remains in effect.
• Assignment: You may not assign these Terms without our consent. We may assign as part of a transfer of the Service or its assets.
• Force Majeure: We are not responsible for delays or failures caused by events beyond reasonable control, including provider outages, network failures, or legal restrictions.
• Notices: Legal notices to support@shrivo.com. We may notify you by email or through the Service.
• Entire Agreement: These Terms and the Privacy Policy are the entire agreement between you and Shrivo regarding the Service.
• Headings: Headings are for convenience only.

22. Changes to Terms

We may update these Terms at our discretion. If changes are material we will provide at least 30 days notice before new terms take effect. The updated Terms will apply going forward.
